Army admits dumping 64 million lbs. of chem. weapons at sea

It is no secret that the U.S. military has used the ocean as trashcan for munitions in the past. Peter discussed at the Old DSN how federal lawmakers were pressing the US Army to reveal everything it knows about a massive international program to dump chemical weapons off homeland and foreign shores. "The Army now admits that it secretly dumped 64 million pounds of nerve and mustard agents into the sea, along with 400,000 chemical-filled bombs, land mines and rockets and more than 500 tons of radioactive waste - either tossed overboard or packed into the holds of scuttled vessels." Brian pointed me to the Daily Press's in depth coverage of this whole issue. Registration is free and only takes a minute or two and is extremely worthwhile. Included at the site are maps of disposal sites (downloadable as pdfs), stories, descriptions of items dumped including nerve and musturd gas, and rather depressing pictures some are below the fold (all from Daily Press).

A man has been charged in Carlisle, Pennsylvania with filming police officers during a routine traffic stop and faces up to seven years in prison for "wiretapping".

Brian D. Kelly is charged under a state law that bars the intentional interception or recording of anyone's oral conversation without their consent, reports the Patriot News.

The criminal case relates to the sound, not the pictures, that his camera picked up.

His camera and film were seized by police during the May 24 stop, he said, and he spent 26 hours in Cumberland County Prison until his mother posted her house as security for his $2,500 bail. Police also took film from his pockets that wasn't related to the traffic stop, he said.

Kelly, just 18 years old, is obviously extremely scared and has apologized profusely for not knowing the law. he has sought the help of the ACLU in the case.

The charge however is bogus because the law is not adhered to by police officers themselves. An exception to the wiretapping law allows police to film people during traffic stops.

In addition police routinely carry microphones that are wired up to their vehicles to record conversations without the knowledge of anyone whom they stop or question.

This is not the first time this has happened either. Last year a North Middleton Twp. man was charged in a street racing case that involved a wiretapping charge. Police claimed the man ordered associates to tape police breaking up an illegal race after officers told him to turn off their cameras.

Furthermore, just last month a 48-year-old man from Dover, New Hampshire was arrested for "wiretapping" for allegedly recording police while they were investigating him for driving while intoxicated.

In addition we have previously covered stories where camera crews have been threatened with arrest for filming peaceful demonstrations, and where cops have been caught stealing protestor's cameras.

Filming in public is a right every American citizen has under the first amendment, which is why the cops in the case above had to steal the camera and the footage, because there was no legal basis to seize it.

It seems that filming and photographing is now deemed to be a threat per se. Pick from any number of stories archived at www.freedomtophotograph.com for example.

In Seattle, police banned a photography student from a public park. He was taking photographs of a bridge for a homework assignment. The officers who ban him from the park do so without the knowledge of park officials and have no authority to do so.

In Texas a man was first threatened by neighbors and then reportedly accosted and sprayed with pepper spray by police. He was walking around his neighborhood, filming with his new video camera.

In New York, National Press Photographers Association members staged a protest in the New York subway system to bring attention to a proposed law to ban photography in the subway system.


In Philadelphia a magazine photographer was detained and questioned after a parade for taking architectural shots while waiting for a subway train.

In Harrisburg, PA a man was swarmed by 8 Police and accused of being a member of Al-Qaeda after shooting pictures of his new car under a bridge.

We have recently exposed how some police now do not understand that they are violating the rights of individuals. In other cases we have witnessed police pull out pocket constitutions from cars and question their legality.

In addition we have a government which has been mired in scandal for wiretapping US citizens without warrant, yet when the tables are turned US citizens face the full wrath of the corrupt judicial system.

Though clearly Brian D. Kelly had no criminal intent and is likely to escape with just a fine, the case sets a dangerous precedent. US citizens can be arrested and charged for filming on public streets.

It also sets the precedent that those who enforce the law are also above the law.

The conduct of secret nuclear wars since 1991, through the use of depleted uranium weaponry by the United States and Great Britain with their allies, has taken place in the Middle East, the former Yugoslavia, Afghanistan2 and Lebanon.3 It has been carried out for the express purpose of destroying the public health and mutilating the genetic future of vast populations in oil rich and/or pipeline regions.

Carpet and grid bombing with depleted uranium weaponry in Iraq, Yugoslavia and Afghanistan has guaranteed permanent radioactive terrain contamination. The recent discovery that U.S. depleted uranium bombs dropped by Israel on Lebanon in 2006 contained enriched uranium4,5 suggests covert testing of fourth generation nuclear weapons.

The United States and its allies are fully aware that this weaponry violates the Geneva and Hague Conventions and the 1925 Geneva Poison Gas Protocol.6 It meets the definition of WMD in the U.S. Code7 in two out of three categories. And its use violates U.S. military law.8 since the U.S. is a signatory to The Hague and Geneva Conventions.

The blueprint for depleted uranium radioactive poison gas weaponry – dirty bombs, dirty missiles and dirty bullets – was contained in a declassified memorandum9 dated Oct. 30, 1943. It was addressed to Gen. Leslie Groves, who was head of the Manhattan Project, the U.S. effort to build atomic bombs in World War II.

However, at that time, depleted uranium and Agent Orange were new weapons developed under the Manhattan Project but thought to be too horrific to use on a living population.10 Ironically, the atomic bombs dropped on Hiroshima and Nagasaki were deemed to be more acceptable by decision makers in the U.S. government than the use of depleted uranium poison gas weapons.

The recommendation for development of depleted uranium as kinetic energy penetrators was never mentioned in the Groves memo. It was specifically for depopulation.

The Groves memo makes it clear that in 1943, U.S. scientists recommended using radioactive poison gas weapons in order to contaminate the air, water, soil, food, environment and the blood of exposed populations. The long-term contamination is permanent, since uranium-238 has a half-life of 4.5 billion years, making contaminated areas uninhabitable for eternity.

For populations that must continue to live in contaminated areas, the long-term effects are lingering illnesses and mutilation of their DNA. Widespread depleted uranium contamination of DNA in populations results in the potential mutilation of future generations. Mutations induced in the DNA of a single egg or sperm which form a fertilized egg are expressed and repeated in every cell of the developing organism, and defects are passed on to all future generations11.

Not only are U.S. and allied soldiers exposed and civilian populations genocidally targeted, but the depleted uranium pollution is now global.12,13 In reality, we are all Gulf War veterans.

UPDATE: 2pm CST - Matt Kazee has now managed to get in touch with Elaine Brown who told him that she had received a call from federal marshall Gary Dimartino who has admitted that the authorities are coming in at some point but "not to kill" the Browns.

Dimartino also denies that the Brown's house guest Danny Riley was shot at, despite Riley's own witness testimony. It is admitted that Riley was tasered.

Kazee has also revealed that local security hacks have heard police scanner radios, on which it has been suggested that two combat robots are going to be sent into the property at some point soon.

All indicators suggest that the authorities are poised to conduct another brutal show of force on Income Tax protestor's Ed and Elaine Brown's New Hampshire property at any time.

Multiple sources have revealed that the activity that proceeded the aborted siege on the Browns last week is being repeated.

Ed and Elaine Brown joined Alex Jones on air yesterday and revealed that once again their telephone and internet have been cut off, and that there are men prowling around in the trees close to his property.

A call to the internet company concerned provided confirmation that the service has been suspended. Later the same evening the Browns' power was completely cut.

Reports out of New Hampshire have suggested that the same patterns which preceded their June 7 show of force are recurring now. A Manchester blogger who monitors Federal Internet usage, says the same frenzied reading of Ed Brown internet discussions from federal laptops and Verizon data cards has once again kicked in.

In addition black Federal government vehicles have been spotted in the parking lot of the nearby Lebanon Residence Inn. It is believed that federal agents are now occupying a room there.

These suggestions dovetail with Ed Brown's revelations on the Alex Jones show yesterday that an informer had entered the house over the weekend.

Brown described the supposed federal infiltrator as immediately suspicious. He appeared as a hillbilly type who was uncharacteristically loud, opinionated and seemingly self obsessed.

He attempted to provocateur the Browns into a discussion about white supremacy, espousing racist views which of course the Browns categorically do not share and would not be led into discussing.

Eventually he left the house before then calling the Browns minutes before their lines were cut off to tell them he thought they and the 'Constitution Rangers" were weak.

Ed Brown went on record to suggest he believed the agent had been sent to engage in "psychological operations".

Infowars correspondent Matt Kazee is still in the vicinity of the Brown property today but lost all contact with the Browns at around 2.30am this morning.

Kazee has confirmed that the Browns' neighbors have left the area and that all cell phone signals including his own are being jammed.

Kazee also revealed that information he gleaned from locals suggest some form of forceful activity is imminent.

Federal court rules against enemy combatant policy

RICHMOND, Virginia (AP) -- A divided panel from a conservative federal appeals court delivered a harsh rebuke to the Bush administration's anti-terrorism strategy Monday, ruling that U.S. residents cannot be locked up indefinitely as "enemy combatants" without being charged.

The three-judge panel of the 4th U.S. Circuit Court of Appeals ruled the government should charge Ali al-Marri, a legal U.S. resident and the only suspected enemy combatant on American soil, or release him from military custody.

The federal Military Commissions Act doesn't strip al-Marri of his constitutional right to challenge his accusers in court, the judges found in Monday's 2-1 decision.

"Put simply, the Constitution does not allow the President to order the military to seize civilians residing within the United States and then detain them indefinitely without criminal process, and this is so even if he calls them 'enemy combatants,"' the court said.

Such detention "would have disastrous consequences for the Constitution -- and the country," Judge Diana G. Motz wrote in the majority opinion.

"This is a landmark victory for the rule of law and a defeat for unchecked executive power," al-Marri's lawyer, Jonathan Hafetz, said in a statement. "It affirms the basic constitutional rights of all individuals -- citizens and immigrants -- in the United States."

The government intends to ask the full 4th Circuit to hear the case, Justice Department spokesman Dean Boyd said.

"The President has made clear that he intends to use all available tools at his disposal to protect Americans from further al Qaeda attack, including the capture and detention of al Qaeda agents who enter our borders," Boyd said in a statement.

The court said its ruling doesn't mean al-Marri should be set free. Instead, he can be returned to the civilian court system and tried on criminal charges.

The decision is the latest in a series of court rulings against the Bush administration's anti-terrorism program.

Last August, a federal judge in Detroit said the government's domestic spying program violated constitutional rights to free speech and privacy, and the constitutional separation of powers. Five months later, the Bush administration announced it would allow judicial review of the spying program run by the National Security Agency.

A year ago, the Supreme Court threw out Bush's system of military trials for detainees at Guantanamo Bay, saying he had exceeded his authority and was in violation of international treaties. The Republican-led Congress then pushed through legislation authorizing war-crime trials for the detainees and denying them access to civilian courts.

But last week, military judges barred the Pentagon from prosecuting two of the Guantanamo detainees because the government had failed to identify them as "unlawful" enemy combatants, as required by Congress. The decisions were a blow to efforts to begin prosecuting dozens of detainees the government regards as the nation's most dangerous terrorism suspects.

Al-Marri has been held in solitary confinement in the Navy brig in Charleston, South Carolina, since June 2003. The Qatar native has been detained since his December 2001 arrest at his home in Peoria, Illinois, where he moved with his wife and five children a day before the September 11, 2001, terrorist attacks to study for a master's degree at Bradley University.

Federal investigators found credit card numbers on al-Marri's laptop computer and charged him with credit card fraud. Upon further investigation, the government said, agents found evidence that al-Marri had links to al-Qaeda terrorists and was a national security threat. Authorities shifted al-Marri's case from the criminal system and moved him to indefinite military detention.

Al-Marri has denied the government's allegations and is seeking to challenge the government's evidence and cross-examine its witnesses in court. Hafetz said prosecutors haven't charged his client because they lack evidence, "or the evidence they've obtained is through torture, unreliable or unacceptable in civilized society."

Al-Marri is currently the only U.S. resident held as an enemy combatant within the United States.

Jose Padilla, who is a U.S. citizen, had been held as an enemy combatant in a Navy brig for 3 ½ years before he was hastily added to an existing case in Miami, Florida, in November 2005. He was added to the case just a few days before a U.S. Supreme Court deadline for Bush administration briefs on the question of the president's powers to continue holding him in military prison without charge.

Yaser Hamdi, an American citizen captured in Afghanistan in 2001, was released to his family in Saudi Arabia in October 2004 after the Justice Department said he no longer posed a threat to the United States. As a condition of his release, he gave up U.S. citizenship.

If the government's stance was upheld, civil liberties groups said, the Justice Department could use terrorism law to hold anyone indefinitely and strip them of the right to use civilian courts to challenge their detention.

The Bush administration's attorneys had urged the federal appeals panel to dismiss al-Marri's challenge, arguing that the Military Commissions Act stripped the courts of jurisdiction to hear cases of detainees who are declared enemy combatants. They contended that Congress and the Supreme Court have given the president the authority to fight terrorism and prevent additional attacks on the nation.

The court, however, said in Monday's opinion that the act doesn't apply to al-Marri, who wasn't captured outside the U.S., detained at Guantanamo Bay or in another country, and who has not received a combatant status review tribunal.

"The MCA was not intended to, and does not apply to aliens like al-Marri, who have legally entered, and are seized while legally residing in, the United States," the court said.

The court also said the government failed to back up its argument that the Authorization for Use of Military Force, enacted by Congress immediately after the September 11, 2001, attacks, gives the president broad powers to detain al-Marri as an enemy combatant. The act neither classifies certain civilians as enemy combatants, nor otherwise authorizes the government to detain people indefinitely, the court ruled.

The case, which is expected to reach the Supreme Court, could help define how much authority the government has to indefinitely detain those accused of terrorism and to strip detainees of their rights to challenge the lawfulness or conditions of their detention.

A senior US defense official today urged the Congress to fast track a section of the stalled immigration bill that would allow the military to recruit illegal aliens, after recruitment figures released by Pentagon showed that the Army failed to reach its targets for May.

The Development, Relief and Education for Alien Minors, or DREAM, provision in the immigration bill was expected to help boost military recruiting by allowing illegal aliens to enlist as way to obtain citizenship, Bill Carr, acting deputy undersecretary of defense for military personnel policy, told a veterans’ group representatives.

“In other words, if you had come across (the border) with your parents, yet you were a minor child and have been in the U.S. school system for a number of years, then you could be eligible to enlist,” he said. “And at the end of that enlistment, then you would be eligible to become a citizen.” Carr said.

The Pentagon has declared war on US soveriegnty. The Defense Department is treansonously attempting to strong arm Congress into passing a blanket amnesty bill in order that it can facilitate a huge influx of illegal foreigners into the United States armed forces.

In its first significant slip in two years the Army National Guard met only 88 percent of its goal and the Air National Guard met 77 percent of its goal, according to a report released today.

While many media reports have suggested the immigration reform bill is dead, The White House thinks otherwise. President Bush has vowed to get it passed next week when he returns from a European trip,


The US armed forces has already seen an influx of foreign troops, an average of 20% of ground troops in Iraq are now non citizens, this is set to rise to 50% over the next year with foreign recruitment stations facilitating the supply.

Last month the AP also reported that the Santa Fe Police Department is considering the possibility of recruiting Mexican nationals to fill vacant police jobs. Current regulations prohibit non-citizens from serving as police officers, but as a total amnesty would legalize all illegals this problem would dissolve.

Law departments are arguing that they, like the armed forces, should be allowed to recruit foreign nationals into vacant positions.

There now exists a situation in the US where foreigners are being recruited to the armed forces and soon enough to law enforcement.

Think about this, non-US citizens wearing the uniform of American soldiers. These troops would be more likely to fire on US citizens and follow extreme orders. Every empire, when it represses its own people, brings in foreign troops to do the job. Urban warfare drills we have covered over the years show that the military is being prepared for this.

As this issue has raged on and tensions have continued to mount we have also seen that 'Immigration Protests' are being used as a cover for a racist ethnic cleansing movement. The fallout of increased tensions could lead to rioting and may provide the perfect pretext to begin round-up and internment procedures that have been previously outlined in the REX 84 program and were cited in the recent Kellogg Brown and Root contract to construct detention camps which was given to them by Homeland Security.

Add to all this the fact that there is a huge push for a North American Union underway, which is continuing apace in relative secrecy and without Congressional oversight. We have issued several reports, the latest here, covering the fact that a wide range of US administrative law is being re-written in stealth under this program to "integrate" and "harmonize" with administrative law in Mexico and Canada, just as has become commonplace within the EU.

Social, political and economic forces are pulling America apart and driving her toward a bloody conflict that may fracture and Balkanize the nation. The move to cement a legal force of underling workers that will do the dirty work for America while at the same time wiping out middle class opulence and sustainability is a direct avocation of a creation of a massive underclass of illegal, third world, uneducated and poor slaves.

This only serves to benefit one section of society, the elite.

Federal marshals have called Ed and Elaine Brown to tell them that the authorities are coming in to their property at some point soon but "do not want to kill" the Browns.

US Marshall Gary Dimartino, who previously promised the Browns that federal authorities would not raid them only for the feds to then conduct an aborted raid last week, told Elaine Brown that they were coming in.

Given that the Browns now know the marshals have no honor and they have flat out lied before, it is likely that they mean exactly the opposite of anything they openly say to the Browns.
